1. Terms and Conditions

These Terms and Conditions (Terms) apply to all services and goods supplied by TINY TAILS RETREAT PTY LTD (Tiny Tails Retreat, us, we or ours) to each customer (you, your), including any grooming services we provide to your pets (Services).

2. Appointments

You can make appointments through our website or by phone.

Any changes or cancellations to your appointment must be made no less 24 hours prior to your appointment or charges may apply. Changes or cancellation must be made by contacting us by phone or if booked online via the cancellation link in the confirmation email. We reserve the right to charge 50% of the appointment cost for any late cancellations or changes to appointments. No shows on the day will be charged the full appointment fee.

3. Saturday Appointments

Tiny Tails Retreat offers appointments on Saturday on a once a month basis.

All appointments made for Saturdays require a 50% deposit payable at the time of booking the appointment. The deposit will be applied towards the total cost of the appointment and is fully refundable for cancellations and reschedules made more than 48 hours prior to your appointment.

Deposits will not be refunded for any changes made to your appointment within 48 hours of your appointment time. No shows or any cancellations/reschedules made on the day of the appointment will result in a 100% charge of the service.

Deposits will not be refunded for appointments that cannot be completed due to matting.

4. Price and Payment

Any price we provide you is indicative only and is subject to our personal assessment of your pet and the condition of your pet. Prices are subject to change at our discretion.

Unless otherwise agreed in writing with us before providing any Services or Goods to you, the full price must be paid to us immediately upon completion of the Services and/or collection of goods.

If you fail, refuse or neglect to pay for Services, we may hold your pet until such payment is made. Please note that any costs of pet boarding due to non-payment is an additional charge which you must pay.

5. Pickup Policy

Subject to any updated “pickup policy” which is made available on our website from time to time, we will provide you an estimated time for the pickup of your pet when you drop off your pet. We will endeavour to contact you prior to the pick-up time however without any further information, you agree to pick up your pet no later than the time notified to you.

It is essential that you pick up your pet within 1 hour of being notified and prior to closing times. You agree to pay all additional charges for any late collection of pets. A late collection fee will be charged at our applicable rate of $15 per 15 minutes for any pet staying beyond 1 hour after being notified or not collected prior to closing time on the applicable day.

Any pet which is left overnight will incur further charges and, at our absolute discretion, may be transferred to the care of a veterinary clinic or animal shelter.

6. Health & Safety

You must inform us when you drop off your pet if there are any health or behavioural conditions relevant to your pet, including infections, illness or injury or if your dog is anxious around strangers or is known to bite or be aggressive.

We have an open area for pets to socialise, stretch and play before and after the grooming service. You must notify us when you drop off your pet if you would like your pet isolated from other animals in our salon. Our salon may not be able to cater for any separation requests, even if requested. If we consider that your pet presents a safety risk to our staff, other animals or itself, we may separate your pet from other pets, use muzzles, or require you to collect your pet immediately.

Tiny Tails Retreat reserve the right to refuse or cease the Service if there is a potential risk that the service may cause any harm or risk to your, or other, pet’s health or to the safety of any staff or customer.

We will endeavour to contact you as soon as possible if any incident occurs or we become aware of any condition with your pet during the Service.
If, in our reasonable opinion, prompt veterinary treatment is required for your pet, you give consent to Tiny Tails Retreat arranging treatment for the pet at your cost. You acknowledge and agree you are liable for such treatment and that we will not be liable for any veterinary or health treatment or related costs for your pet.

7. Infestations including Fleas and Ticks

Pets with any infestation must not be brought to our premises. If your pet has a parasitic infestation, we ask that your grooming appointment is rescheduled to a time when your pet is free from the said infestation. 24 hours’ notice must be provided to avoid any cancellation charges.

If any fleas or ticks are found on your pet, we will use a medicated shampoo on your pet and we are required to undertake additional disinfection of our premises and equipment. An additional charge of $50 will be applicable to your bill. We will not be held responsible for any infestation treatment, including any irritation or infection caused by the presence or removal of ticks or fleas.

8. Photography

By engaging us for the grooming services for your pet, you also consent to the taking of images or recordings of your pets by us which may be used as part of our grooming services and may be used for our promotional and advertising purposes or for our record purposes. You agree that all intellectual property rights in such images or recordings shall be the absolute property of Tiny Tails Retreat.

9. Credit Card Authorization

You hereby authorise Tiny Tails Retreat to charge your nominated credit card for all agreed-upon fees and services rendered, including but not limited to appointments, cancellations, no-shows, or late fees, as applicable under Tiny Tails Retreat’s stated policies.

You acknowledge and agree that charges may be processed at the time services are rendered or in accordance with the terms outlined at the time of booking.

You are the authorised user of the credit card provided and will not dispute the payment with your credit card company, so long as the transaction corresponds to the terms indicated in this authorisation.

This authorisation shall remain in effect unless revoked by you in writing, and any outstanding balance will remain your responsibility.

10. Disclaimer and Exclusion of Warranty

Subject only to clause 9.4, to the maximum extent permitted by law, any condition, guarantee or warranty which would otherwise be implied into this Agreement is hereby excluded.

To the maximum extent permitted by law and subject to the following paragraph of this Clause 8, you agree that Tiny Tales Retreat has no liability, and will not be liable, to you or any other person whether in contract, tort or otherwise for any costs, expenses, injury, loss or damage of any kind (including, without limitation, direct, indirect, special or consequential loss or damage of any kind or indirect costs) you, your pet or any other person may suffer or incur (whether by our negligence or fault or otherwise, except where Tiny Tails Retreat has intentionally acted in bad faith) arising in any way in connection with the provision of the Services.

If rights are conferred upon you or obligations are imposed upon Tiny Tails Retreat by legislation which cannot be excluded, the provisions of this Clause 8 shall be read subject to those rights or obligations, and to the extent permitted by such legislation Tiny Tails Retreat hereby expressly limits its liability under any such legislation to the maximum extent permitted by law.

The following guarantee applies only to a “consumer” as defined in the Australian Consumer Law: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

11. Indemnity & Release

You indemnify us against all claims made against, or costs incurred by, us arising out of or in connection with:

- any breach by you of these Terms or any applicable law;
- any injury to, or death of, any person or other pet caused by any act by you or your pet.

You irrevocably release us in respect of any claim, loss, cost or damage arising directly or indirectly from:

- any loss of or damage to any property (including any loss, damage or injury to your pet); and
- the injury or death of any person,

arising from, or in relation to, the provision of the Services.

12. Miscellaneous

If any provision of this terms and conditions or its application to any person or circumstance is or is found to be invalid or unenforceable the invalidity or unenforceability of such term shall not affect the validity or enforceability of the other terms of this terms and conditions or the application of such provisions to any person or circumstance and the said other provisions shall remain in full force and effect.

Tiny Tails Retreat reserves the right to amend any of terms and conditions from time to time and at its own discretion.

This Agreement shall be construed in accordance with and shall be governed by the laws in force in the State of Victoria and each of the parties irrevocably submits to the jurisdiction of courts of that State and the appellate courts there from.
